Terms of service for hosting sites on 15mb.net

1.) Throughout this agreement, 'we' 'us' and '15mb.net' refers to the owner and administrator of 15mb.net. 'You' refers to you the customer, in the form of an individual, a business or an organisation. 'Webspace' refers to the hard drive space on the internet that we give you access to in order to place material on the internet.

2.) This agreement shall be governed and construed in accordance with English law and you hereby submit to the exclusive jurisdiction of the English courts.

3.) You undertake to have provided full and accurate information on the signup form to the best of your knowledge and belief. You agree to notify 15mb.net (through direct correspondence, email or otherwise) in the event of a change in this information.



4.) USAGE

a.) You may not use your account to transfer any illicit advertising, unsolicited email, mailbombs, chain letters, "spam", or any material that is offensive, bigoted, racist, illegal, illicit, threatening, pornographic, hateful, or breach of criminal or civil law.

b.) You may not use your account to transfer any computer virus, "phisher", spyware, adware or any other program or file likely to damage a computer, invade someone's privacy or cause them inconvenience.

c.) You agree that you will not, in uploading material to or otherwise using 15mb.net's services, violate any applicable national or international law, whether civil or criminal.

d.) We reserve the right to remove down files, without notice, that are offensive, bigoted, racist, illegal, illicit, threatening, pornographic, hateful or in breach of criminal or civil law to the degree that we have reasonable grounds to deem them harmful or inappropriate. You agree to remove such files on our request.

e.) You may not resell or reallocate the webspace and/or services we provided to you IN ANY WAY.

f.) You note and agree to us checking your account via FTP for breaches of this agreement on a regular basis.

g.) Should legal proceedings be brought against us or against UkHost4u due to usage of the services we provide to you resulting from your actions, or as a result of violation of this agreement by you, you agree to indemnify and hold harmless 15mb.net and Ukhost4u from and against all resulting costs, damages and expenses.



5.) TERMINATION

a.) We reserve the right to terminate your account immediately, and without refund, if you violate this agreement.

b.) Should you violate this agreement, you waive all rights to refund and agree to indemnify and hold harmless 15mb.net and Ukhost4u from and against all resulting costs, damages and expenses. If it is terminated by us for any reason not expressed in this agreement, you will be entitled to a refund proportional to the length of service unavailability, depending on your package. This does not affect your statutory rights.

c.) You have the right to cancellation and full refund for one week after payment. Following this one week period, any cancellation of the service by you except where otherwise specified in this agreement will not be accompanied by a refund.

d.) If you wish to terminate your contract you must express so in email / writing to us. Non-usage of services does not mean that payment will not be required.



6.) SERVICE GUARANTEES AND RESTRICTIONS

a.) Like most hosts, we cannot guarantee 100% server uptime. However, you shall be entitled to a refund proportional to the length of the downtime upon request (by email or in writing) if the downtime is longer than 48 hours in one stint. Should you terminate the contract (within one month of the specified downtime) because of proven downtime amounting to 48 hours or more within 14 days, you will be entitled to a refund for the months you are cancelling.




7.) PAYMENT

a.) Payment shall be made through post (by cheque), in person by cash or cheque, or via the PayPal service.

b.) Should your payment not reach us due to problems with the postal service (including but not limited to the envelope or package containing your payment being lost in the post) or due to problems with PayPal you agree to send another payment until we have received the correct amount from you. If you use the PayPal service to pay, you shall "donate" the amount needed for us to receive the correct amount from you after Paypal deductions. You are entitled to a receipt of payment should you request one.

c.) You should not pay until you have been instructed to do so via email invoice from us, and you agree that should you pay before receiving said email we will be under no obligation to accept this payment for your account nor refund you, and cannot be held responsible for any money you lose in this way.



8.) PRIVACY

a.) Should we give you an address in order for you to pay by post you agree to keep this information entirely confidential and not use it for any purpose other than payment without prior written consent of us.

b.) Likewise, all personal details you provide to us will be kept confidential to the best of our abilities, but we shall not be responsible for their disclosure caused by illicit or illegal actions by you or any third party. We shall not disclose any information about you to any third party, except where we are bound by law to do so or where you give us permission.

c.) Each  contract with each client of 15mb.net will be individual to that client and be kept entirely confidential by all participating parties to the best of their ability.

d.) Communications and agreements between parties may be recorded for contract enforcement purposes, including but not limited to MSN Messenger chat logs, saved electronic mails and voice chat recordings. You hereby agree to and permit this. We will endeavour to keep this information confidential and secure. If you reveal details of your "Mix-n-Match" contract, including but not limited to payment amounts and length of contract, to any third party your account will be terminated with immediate effect and without refund.

e.) You agree not to set or use a password (whether it be for your FTP or email account) that any third party may relate to you or your login name, or to set or use a password that is identical to any one word in the Oxford English Dictionary.

f.) You note and accept that 15mb.net Administrators will be forced to access your password and use it to set up your account. We will not use your password for any other purpose than this. You acknowledge that as we do not use a secure server or encryption on our form fields, so we strongly advise you to use a password different to one you use for any other site or service.

g.) You agree not to give out your password, or any clues or information relating to your password, to any third party under any circumstances without prior written consent of us. You agree to take reasonable precautions against another accessing your password. Should a third party access the services due to you breaking this clause, you agree to accept total responsibility for the consequences, and indemnify and hold harmless 15mb.net and Ukhost4u from and against all resulting costs, damages and expenses.



9.) BANDWIDTH POLICY

a.) At the current time, 15mb.net does not enforce bandwidth (or "transfer") restrictions.
b.) However, acceptable usage of the service amounts to no more than 250mb transfer a month on the basic package, 500mb per month on the advanced package and 1000mb per month on the super package.
c.) On Pick n Mix packages, unless otherwise specified, the acceptable usage is 250mb per month.
d.) Bandwidth includes all transfer on your account, whether it be by web page, email or FTP access.
e.) Should the service experience downtime due to 15mb.net exceeding its bandwidth limitations without any one customer going over acceptable usage policy, then we shall purchase more bandwidth. You hereby accept that such a situation is beyond our reasonable control and may occur, and thus waive your right to claim refund in such circumstances, unless the downtime exceeds seven consecutive days in which case clause 5 shall apply as normal.
f.) Should 15mb.net exceed its bandwidth limits in a month where you have exceeded "acceptable usage" of your account, you agree to provide us with the necessary funds (up to £15, specified by us) to purchase the extra bandwidth. Should you fail to provide this money within seven days, then you accept that your account will be terminated and waive all right to refund.



10.) MISCELLANEOUS

a.) You acknowledge that you are at least 18 years of age.

b.) We will endeavour to provide you with the best possible service and we will install scripts, forums etc. (as advertised) onto your webspace on request. However, this service cannot be guaranteed at all times if the volume of the requests becomes to large.

c.) Any free accounts we provide are a privilege not a right and we reserve the right to terminate them at any time for any reason without notice.

d.) You may not launch, authorize, or condone launching cyber attacks on our services (including but not limited to packet flooding) or to take part in such attacks yourself. Should you do so, you agree to waive all your rights to refund under this agreement, and refund us the cost of fixing the damage and reimbursing those customers who have been affected and claimed refund under the Terms of Service. You also agree to indemnify and hold harmless 15mb.net and Ukhost4u from and against all resulting costs, damages and expenses.

e.) Due to spam robots, we can only accept free account signups from UK Internet Service Provider email accounts, eg joe.bloggs@ntlworld.com or joe.bloggs@btopenworld.com. We apologise for any inconvenience this might cause. You recognise that should you sign up using a non UK ISP email address then your free account application will not be accepted.



11.) CHANGES

We reserve the right to change these Terms of Service within the boundaries of English law at any time. We shall notify you via email ten days in advance of any such changes, and your continued usage of the services after ten days of such an email being sent indicated acceptance of the revised terms. Should you decide to terminate your account due to changes in the terms of service, you will be entitled to refund proportional to the length of time left on your account, depending on your package.
